These Terms of Service (“Terms”) govern access to novusmodern.com and purchases from Novus Modern. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website.
1. Store operator
Novus Modern is an online business serving eligible customers in the United States (“Novus Modern,” “we,” “us,” or “our”). These Terms apply to the online storefront available at novusmodern.com.
2. Eligibility and lawful use
You must be legally capable of entering a binding agreement in your place of residence. If you use the website on behalf of another person or organization, you represent that you are authorized to bind that person or organization.
You may use the website only for lawful personal or business purchasing purposes.
3. Product information
We aim to describe products accurately, including materials, dimensions, color, compatibility, and included components. Screen settings, lighting, manufacturing tolerances, natural materials, and production updates may cause reasonable variation.
Please review the product page, measurements, compatibility information, and care instructions before ordering.
We may update product information or discontinue a product without notice. An update does not affect rights relating to an order already accepted, except when a correction is required by law or agreed with the customer.
4. Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not require us to accept an order.
We may refuse or cancel an order before shipment because of inventory errors, pricing errors, suspected fraud, payment failure, shipping restrictions, or legal requirements. If we cancel after payment, we will promptly refund the canceled amount.
We may limit quantities that appear intended for unauthorized resale or misuse. Contact us before placing a high-volume or commercial order so availability and shipping can be confirmed.
5. Prices, discounts, and taxes
Prices are displayed in U.S. dollars unless stated otherwise. Applicable discounts must be entered or automatically applied before checkout is completed. Discounts cannot be exchanged for cash and cannot be applied retroactively unless we agree.
Applicable sales taxes are calculated at checkout when required.
If a clear pricing or description error is discovered before shipment, we may contact you for confirmation at the corrected price or cancel and refund the affected item.
6. Payment
You agree to provide current, complete, and accurate billing information and represent that you are authorized to use the selected payment method.
Payments are processed through Shopify Checkout by third-party providers, including Stripe Card Payments, PayPal, and eligible digital wallets as displayed. Their terms and privacy practices may also apply.
7. Shipping
Shipping destinations, charges, processing times, tracking, and delay procedures are described in our Shipping Policy, which is incorporated into these Terms. Delivery estimates are not guarantees unless expressly stated.
8. Returns, cancellations, and refunds
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms.
Nothing in these Terms limits a consumer right that cannot lawfully be waived.
9. Customer accounts
If customer accounts are enabled, you are responsible for safeguarding login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
We may suspend or close an account to protect the customer, the store, or other users.
10. Prohibited conduct
You may not:
- use the website for fraud, unlawful activity, or infringement of another person’s rights;
- interfere with website security, checkout, availability, or technical operation;
- introduce malware, scrape the website at unreasonable volume, or attempt unauthorized access;
- submit false order, payment, identity, review, or support information;
- copy or exploit website content for unauthorized commercial use; or
- use our products in a way that is unlawful or contrary to product safety instructions.
11. Intellectual property
The Novus Modern name, website design, original text, graphics, photographs, logos, and other store content are owned by or licensed to the store operator and are protected by applicable intellectual-property laws.
You may view and use the website for personal shopping, but no broader license is granted. Third-party trademarks remain the property of their respective owners.
12. Reviews and other submissions
If you submit a review, photograph, suggestion, or other content, you represent that you have the right to provide it and that it is not unlawful, misleading, defamatory, infringing, or harmful.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the store, subject to our Privacy Policy. We may moderate or remove content that violates these Terms.
13. Third-party services and links
The store relies on Shopify and may contain third-party tools, payment services, integrations, or links. A third party’s own terms and privacy policy govern its independent services.
We are not responsible for unrelated third-party websites or services that we do not control.
14. Electronic communications
You agree that order confirmations, disclosures, notices, and customer-service communications may be provided electronically. Marketing messages are optional where required, and you may unsubscribe using the method provided in the message.
15. Disclaimers
To the maximum extent permitted by law, the website is provided on an “as available” basis. We do not promise uninterrupted access or that every website error will be corrected immediately.
Product warranties, if any, are those expressly stated on the product page or provided by the manufacturer. These disclaimers do not exclude warranties or remedies that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, Novus Modern will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the website or a product.
Where liability can legally be limited, aggregate liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim. This limitation does not apply to fraud, willful misconduct, personal injury caused by negligence, or any liability that applicable law does not allow us to limit.
17. Responsibility for misuse
You are responsible for losses reasonably caused by your unlawful misuse of the website, violation of these Terms, or infringement of a third party’s rights. This provision does not create liability beyond what applicable law permits.
18. Governing law and disputes
These Terms are governed by applicable law, without depriving a consumer of mandatory protections that apply in the consumer’s place of residence.
Before beginning formal proceedings, please contact support@novusmodern.com and allow 30 days for a good-faith attempt to resolve the concern. Any unresolved dispute may be brought before a court or authority having lawful jurisdiction.
19. Suspension and termination
We may suspend or terminate website access for conduct that violates these Terms, threatens security, or exposes the store or others to legal risk.
Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, and dispute terms, will continue to apply.
20. Changes to these Terms
We may update these Terms for future use of the website. The revised version will be posted with an updated date. Material changes will receive additional notice when required by law.
Terms in effect when an order was accepted continue to govern that order unless a change is required by law or agreed with the customer.
21. General provisions
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced here and any product-specific terms shown before purchase, form the agreement between you and Novus Modern concerning the website and purchases.
